湖北省地质矿产勘查控制条例(2017修正)
第一条 为增强地质矿产勘查控制,保养勘查次第,维护勘查者的合法权益,促进经济开展,依据《中华人民共和国矿产资源法》和有关法律、法规,结合本省实践,制定本条例。 第二条 凡在本省境内从事矿产资源勘查、区域地质调查等任务的,必需遵守本条例。 第三条 省人民政府地质矿产控制部门主管全省地质矿产勘查的监视控制任务;市、州、县人民政府地质矿产控制部门担任本行政区域中原质矿产勘查的监视控制任务。 第四条 省地质矿产控制部门担任对全省地质矿产勘查年度方案执行状况实施监视审核,活期发布地质矿产勘查行业有关统计资料和地质矿产勘查的经济、社会效益状况。 县以上地质矿产控制部门应对勘查项目实施状况启动监视审核。 第五条 地质勘查单位应于每年年底前,将本单位地质矿产勘查项目年度方案执行状况及有关统计资料报送项目所在地的地质矿产控制部门和省地质矿产控制部门。 第六条 矿产资源勘查实行一致的区块注销控制制度。 从事矿产资源勘查活动,必需开放勘查注销,支付矿产资源勘查容许证,取得探矿权,成为探矿权人;曾经依法开放取得采矿权的矿山企业在划定的矿区范围内为本企业的消费而启动的勘查除外。 国度规则由国务院地质矿产主管部门审批发证的矿产资源勘查项目,由省地质矿产控制部门初审,报国务院地质矿产主管部门审批发证;其他矿产资源勘查项目,由省地质矿产控制部门审批发证。 第七条 矿产资源勘查出资者为探矿权开放人;国度出资勘查矿产资源的,由国度委托勘查的单位开放探矿权。 探矿权开放人应按注销控制机关的规则报送有关文件、资料,并操持注销手续,交纳探矿权经常使用费;探矿权开放人开放国度出资勘查曾经探明矿产地的区块,还应当交纳经国度认可的评价机构评价的国度出资勘查所构成的探矿权价款,支付矿产资源勘查容许证。 有偿取得的探矿权可以依法转让,转让条件按国务院有关规则执行。 第八条 对国度和省奖励勘查的矿种或许区域启动勘查的,按国度规则减缴、免缴探矿权经常使用费和探矿权价款。 第九条 矿产资源勘查容许证的有效期最长为3年。 要求延伸勘查任务时期的,应在矿产资源勘查容许证有效期满前1个月内操持延续注销手续,每次延续不得超越2年。 探矿权人逾期不开放操持延续注销手续的,注销控制机关予以公告注销。 第十条 注销控制机关应当自颁发矿产资源勘查容许证之日起10日内,将注销发证项目的称号、探矿权人、区块范围和矿产资源勘查容许证期限等事项,通知勘查项目所在地的地质矿产控制部门。 注销控制机关应当活期公告勘查注销发证状况。 第十一条 探矿权人应当自支付矿产资源勘查容许证之日起6个月内末尾施工。 在施工之前,应向注销控制机关报送施工报告,并从施工之日起10日外向勘查项目所在地的地质矿产控制部门报告施工状况。 探矿权人因故须中途停工的,应及时向注销控制机关提出停工开放,操持停工手续。 停工时期最长不得超越6个月。 探矿权人应按国务院有关规则成功最低的地质勘查资金投入。 第十二条 探矿权人改动同意的勘查区块范围、任务对象,经同意转让探矿权及探矿权人改动称号或许地址的,须在矿产资源勘查容许证有效期外向注销控制机关开放操持变卦注销手续。 第十三条 因故要求中途撤销勘查项目的,应向注销控制机关提出撤销开放,提交项目终止报告,操持注销注销手续;曾经成功勘查项目义务的,应向注销控制机关提交项目成功报告,操持注销注销手续。 探矿权人在操持注销注销手续后,必需按有关规则汇交地质资料。 不按有关规则汇交地质资料的,不得开放新的勘查项目。 自注销之日起3个月内,原探矿权人不得开放曾经注销的区块范围内的探矿权。 第十四条 探矿权人在矿产资源勘查容许证有效期内探明可供开采的矿体后,经注销控制机关同意,可以中止相应区块的最低地质勘查投入,并可以开放保管探矿权。 保管探矿权的期限,最长不得超越2年,要求延伸保管期的,可以开放延伸两次,每次不得超越2年;保管探矿权的范围为可供开采的矿体范围。 在中止最低勘查投入时期和探矿权保管时期,探矿权人应当按规则交纳探矿权经常使用费。 第十五条 制止任何单位或许团体合法进入他人依法取得的探矿权的勘查作业区内启动勘查、开采活动和阻碍、搅扰正常勘查作业活动。

Explanatory Notes on Main Statistical Indicators
Number of exploration licenses — refers to the number of valid exploration licenses issued and the number of exploration licenses cancelled by the exploration registration administration agency with jurisdictional power according to law within the prescribed limits of examining and approving and license-issuing authority.
Valid (exploration license) — refers to the valid exploration licenses at the end of the reporting period, including those that have been newly issued, modified or continued and other valid exploration licenses.
